Conditions

These general terms and conditions (GTC) apply to all orders for goods via the kochbretter web shop at www.kochbretter.ch
2. OFFER AND CONCLUSION OF CONTRACT
2.1 The promotion of products in the online shop does not constitute a legally binding offer, but rather an invitation to order. Kochbretter reserves the right to correct any incorrect information at any time.
2.2 By clicking on the “order for a fee” button, the customer makes a binding offer to purchase the goods listed in the virtual shopping cart at the listed total costs (price of goods, VAT, shipping costs, but excluding any applicable customs duties). By asking the customer to pay as part of the further online ordering process, Kochbretter accepts the order, which means the purchase contract is concluded. Receipt of the order and payment will be confirmed to the customer by email. Kochbretter is entitled to cancel orders without giving reasons and without legal disadvantages up to the time of dispatch, with a full refund of the payment already made.
3. PRICES AND SHIPPING COSTS
3.1 Unless expressly stated otherwise, all prices in the web shop are in CHF.
3.2. Unless expressly stated otherwise, the goods prices stated in the web shop are plus statutory VAT and shipping costs (costs for normal parcel shipping from Frenkendorf, Switzerland). When shipping to countries outside of Switzerland, customs duties are also borne by the customer.
4. PAYMENT AND DELIVERY
4.1 Delivery only against Paypal, credit card or advance payment. Payment is made in CHF.
4.2 Goods in stock are usually dispatched within 4-5 working days in Switzerland and within 4-8 working days in the EU after receipt of payment by Kochbretten. Ordered goods are usually dispatched within one month. In the event of delivery delays, the purchaser will be notified.
5. WARRANTY, GUARANTEE, LIABILITY
5.1 The customer checks the goods upon receipt to ensure that they are free of defects.
5.2 Any defects must be reported immediately, but no later than 8 days after discovery. The notification of defects must be made in writing and accompanied by the defective product. With the notification of defects, Kochbretter has the right to have the reported defect or damage checked by its own employees or experts of their choice. In the event of a justified complaint about defects, the purchaser will receive replacement goods free of charge; the return shipping costs will be reimbursed.
5.3 To the extent permitted by law, liability for consequential damage caused by defects is rejected.
6. PRIVACY
Kochbretter treats passively received information about users of the website confidentially and this will not be passed on to third parties, with the exception of passing on data to law enforcement authorities in the event of criminal acts. Kochbretter reserves the right to keep records of ordering processes for internal accounting purposes and internal statistical evaluations. In order to best ensure customer satisfaction, Kochbretter is entitled to use records of order processes for its own customer information purposes and its own follow-up offers.
7. INTELLECTUAL PROPERTY RIGHTS
The contents of the webshop may not be reproduced for any purpose other than to process the order without the consent of Kochbretten. All intellectual property rights of the cooking boards are expressly reserved. This includes in particular trademark rights (whether registered or not), name rights, design rights and copyrights. Such rights are exclusively available to Kochbrett.
8. VOIDITY OF INDIVIDUAL PROVISIONS
According to the will of the parties, the possible nullity or invalidity of individual provisions of these General Terms and Conditions does not result in the invalidity of the entire contract or the remaining provisions. Any void or invalid provisions must be replaced by permissible provisions that correspond as closely as possible to the replaced conditions from an economic perspective.
9. APPLICABLE LAW, JURISDICTION
Swiss law applies exclusively, excluding international conflict of laws. The exclusive place of jurisdiction is Baselland, Switzerland.
